Expert Witness


Marc Egerton can be appointed as a single party expert, a single joint expert, an expert adviser, or as a mediator. Apart from mediation services, which have their own fee structure (see below), his hourly rate is £175. No VAT is chargeable. Most initial reports cost between £1,500 and £4,000, depending upon the complexity of the case and the volume of documentation to be considered, but a simple opinion may cost only a few hundred pounds. Expert adviser reports for the benefit of the instructing party only are usually 25% to 50% less expensive than reports to the court, and may well prove to very useful in cases where there is some doubt about liability.
Travelling expenses (40p per mile by car or first class rail travel) are payable in addition where necessary. Estimates will always be provided on request after documentation has been delivered for initial (no cost) perusal.

Marc will accept appointments for most types of financial services case where an opinion is being sought on liability, and many of his appointments involve allegations of mis-selling or poor advice in relation to pensions, investments or life assurance. He will not accept appointments which are exclusively concerned with pure (non-life) insurance contracts, stockbroking activities, or non-regulated lending activities. He is happy to consider appointments where a view on quantum is required as part of a wider report, but may refuse to act where a view on quantum only is being required. If, in his opinion, it would be more appropriate for a specialist quantum expert (e.g. an accountant or an actuary) to be appointed, he may suggest that his appointment is restricted to liability issues only.

Marc is happy to act for either claimants or defendants, or both. He has acted on behalf of individuals, insurance companies, investment companies, independent financial advisers, mortgage firms, pension companies, solicitors (as defendants) and accountants, as well as a police force in criminal matters.

Instructions will normally only be accepted from lawyers. Individual claimants or defendants cannot instruct Marc themselves, although he will consider direct instructions from organisations (e.g. a police service).

 

Mediation Services

Marc is a trained mediator, and mainly acts in financial services cases, although others will be considered. The fees for this service are £1,500  for a full day mediation (i.e. if a full day is booked, even if a settlement is agreed in less time than this), and £850 for a half day mediation. These fees include time for preparation and reading the papers before the mediation. In addition, venue hire and travelling expenses will be charged. All charges are to be split equally between the two parties and are payable in advance. Again, no VAT is chargeable.

Mediation services are normally undertaken in Cheshire or Manchester, but if required by the parties can be anywhere in the United Kingdom (although this may increase the cost).
